Facts :- I was a short stay respite resident who is disabled through a road accident but fortunately still complete with all my mental faculties. During my stay in 2013 I found the food offered was 'stodgy', cheap, unappetising and nutritionally unbalanced. I found the home was understaffed and propped up by unfamiliar agency staff who often knew little more about the home than strangers which could have been pulled in off the street. The facilities were outdated and required modernisation to bring them up to todays expected standards. Assistance with bathing needs was often around a week and on occasions took a ridiculous Ten days. Neither could I get a proper nights sleep or rest in this so called rest home due to the loud intermittent slamming of doors in the early hours of the mornings.
I made the owners / management aware of all these problems and they promised to improve these issues. After a brief improvement matters quickly declined and at this point I told them I was witholding further payments pending them delivering their promised improvements which never materialised. At this stage it was laughable at how quickly they could issue an eviction notice once they discovered I was seriously not going to pay for inferior or non-existant services.
They ended up taking me to the County Courts in Huddersfield where they lost their case against me which I defended. The Judge agreed with my sentiments and stated under the law why should I or anyone be expected to pay for a service that was not delivered. Steer clear!
